Distance Sales Agreement

This Distance Sales Agreement (hereinafter – the Agreement) is concluded between the owner of the online stores www.setesky.lv, Vjačeslavs Sivjakovs, registration number 30058112206, address Pumpuru iela 7, Dobele, Dobele parish, Dobele municipality, LV-3701 (hereinafter referred to as the Seller), and a Buyer at least 14 years old who places an order and purchases from the online store www.setesky.lv (hereinafter – the Buyer). This Agreement applies to all orders and purchases made via the www.setesky.lv online store (hereinafter – SETESKY website). This Distance Sales Agreement does not apply to purchases made physically from the Seller.
General Terms
1. The Buyer orders, purchases, and pays, while the Seller delivers and sells design items (hereinafter – Products) according to the terms of this Agreement.
2. The Buyer purchases Products by completing the relevant order form on the SETESKY website. By placing an order, the Buyer agrees to provide accurate information, including name, surname, delivery address, and contact details. The Buyer agrees to notify the Seller of any changes within 24 hours of receiving order confirmation by emailing setesky@inbox.lv. The Buyer is responsible for providing correct data; otherwise, delivery may be delayed or impossible. Placing an order is considered the Buyer’s offer.
3. The Seller agrees to conclude this Agreement to deliver the ordered Products, and the Buyer agrees to purchase the Products at the specified price. By placing an order, the Buyer confirms having read, understood, and agreed to the terms of this Agreement and commits to comply with them. Orders are not allowed if the Buyer has not agreed to the terms. The Agreement is prepared in accordance with the laws of the Republic of Latvia.
4. This Agreement applies to all Buyers, whether unregistered clients or members of the SETESKY Loyalty Program who receive additional benefits and discounts.
Purchase Price and Delivery
5. Product prices on the SETESKY website are indicated in EUR and do not include value added tax (VAT). Products are sold at prices effective at the time of ordering. Total delivery cost may include surcharges. Bank fees may apply depending on the Buyer’s bank or payment method.
6. The Buyer pays for Products on the www.setesky.lv online store via debit or credit card (MasterCard, Visa, Maestro, Visa Electron) or by bank transfer to the account number provided on the prepayment invoice.
7. The Seller delivers the Products to the Buyer’s specified address according to courier service tariffs. The Buyer pays shipping and product costs together before confirmation and delivery. Delivery costs are included in the invoice. The electronic invoice is valid without signature.
8. Upon delivery, the Buyer agrees to sign a receipt confirming Product receipt.
9. Orders can be placed 24/7, but order processing is done during working days from 9:00 to 17:00; no processing on Saturdays or Sundays. The Seller sends order confirmation by email. If no confirmation is received, the order is not accepted. Order processing begins after funds are credited to the Seller’s account.
Estimated delivery time is shown at purchase and in the Buyer’s account and confirmation email.
Quality Guarantee and Liability
11. SETESKY does not guarantee that Products will always meet the Buyer’s expectations beyond the product description. If dissatisfied with quality, the Buyer may return the specific Product upon receipt for a full refund.
12. Products on the SETESKY website may slightly differ in size, shape, or color due to technical differences of devices used for ordering or other justifiable differences.
13. Product descriptions and usage instructions are provided for each Product on the website.
Return and Withdrawal Rights
14. The Buyer has the right to withdraw from the purchase and return the Product within 14 calendar days under the Consumer Rights Protection Law of Latvia. The Buyer should verify that the Product matches the order upon receipt (color, name, and essential parameters).
15. If the Product is incorrectly assembled, the Buyer can exchange it within 14 days by filling out a return form. The Seller covers courier costs in such cases.
16. For exercising withdrawal rights, please note:
16.1. Returned Products must be unused. If the condition worsened due to improper storage, withdrawal rights cannot be used.
16.2. The Buyer must keep the original packaging intact.
16.3. To withdraw, the Buyer must contact the Seller by email at setesky@inbox.lv to receive and fill out a withdrawal form, then send it back to the Seller.
16.4. The Buyer must keep courier delivery documents for both receipt and return shipments.

16.6 The Seller refunds the purchase and delivery costs within 14 calendar days after the Seller receives the returned Product at the warehouse (Baznīcas iela 22, Dobele) based on the Buyer’s withdrawal.
16.7. Refunds are made using the same payment method that the customer used for the transaction.
Buyer’s Rights for Non-Conforming Products
17.1. Product defects are corrected, or defective Products are replaced or returned according to these terms and Latvian law.
17.2. Complaints about poor quality or incomplete Products can be sent by email to setesky@inbox.lv, returning the defective Product if possible.
17.3. Complaints must include:
17.3.1. Invoice and order number (if possible, attach the invoice), Description of defect or missing parts, Evidence such as photos of the Product, defect, or packaging.
17.3.2. indicate the defect, signs of damage, or missing part of the Goods;
17.3.3. other evidence must be submitted, such as a photograph of the Goods, a photograph of the defective area (if it is mechanical damage and it is possible to photograph it), a photograph of the packaging of the Goods, etc.
17.4. The Buyer may request free correction or replacement unless impossible or unreasonable.
17.5. Complaints will be responded to within 15 days. If more time is needed, the Seller will inform the Buyer in writing with a reasonable deadline.
17.6. Refunds are issued only if the Seller confirms the Product is defective. The Seller may require return of the defective Product.

Final Terms and Dispute Resolution
19. The Seller is liable only for direct losses caused by breach of this Agreement.
20. The Seller may change the Agreement or partially/fully suspend the SETESKY website, informing Buyers via website, stores, or email and requesting confirmation of the updated Agreement before new orders.
21. This Agreement remains in effect until all obligations between Seller and Buyer are fulfilled.
22. The Agreement is governed by the laws of the Buyer’s country and disputes are resolved in the courts of the Seller’s jurisdiction.
23. If any provision is deemed illegal or unenforceable, the rest of the Agreement remains valid.
24. The Seller may block Buyers from purchasing if fraudulent or improper actions are detected.
25. Disputes should be resolved by negotiation. If unresolved, Buyers may file complaints with the Consumer Dispute Resolution Commission in Riga or use the online dispute resolution platform at https://ec.europa.eu/consumers/odr/.
Personal Data Processing
26. The Buyer’s personal data is used to identify the Buyer, process and deliver orders, prepare accounting documents, refund amounts, and administer financial and other obligations under this Agreement and cooperation documents related to services offered on SETESKY websites.
